Woman claims she was victim of West side rape suspect

SAN ANTONIO - A woman who claims she was a victim of West side rape suspect Jose Garcia, 32, said she is determined to see him serve jail time for the alleged attack Sunday night.


San Antonio police arrested Jose Luis Cruz Garcia, 32, after 10 p.m. Sunday at the corner of 18th and Guadalupe streets. He was later booked into the Bexar County jail on a charge of sexual assault.

Detectives said they caught Garcia literally with his pants down, in the act of sexually assaulting a woman in the back seat of his car.

Elizabeth Chaboya said she is that woman. While KSAT 12’s policy usually is to protect the identity of sexual assault victims, Chaboya wanted to reveal her identity in the hope of encouraging other women to come forward and report attacks.

With a swollen purple and red upper lip, and scratches on her arms and neck, she answered her door Monday morning and detailed the events which she said took her by surprise.

Chaboya said she was upset about something Sunday night and went for a walk to calm down. She said she soon came upon a man, sitting in his car with the door open.

“I told him if he wanted to close it because the battery was going to run out. I thought maybe he was drunk or something," she said. “And then he just jumped out and grabbed me and threw me in the back of the car and started to attack me."

Chaboya said she tried to fight off her attacker, but he continued pummeling her with his fists.

Finally, she said, a friend heard her screaming for help and called 911.

Police said they suspect that Garcia is behind a series of rapes on the near West side. They said at least three other women have been attacked in the past month, but the victims, so far, have not been willing to cooperate.

Chaboya, though, is determined to see the case through.

"I'm going to pursue pressing charges and stay with the case," she said. “People shouldn't be allowed to get away with anything like that. Man, woman, it doesn't matter."
