Naval recruiter accused of sexual assault

Juan Jose Pena, a 28-year-old U.S. Navy recruiter, is free on bond after being accused of getting a recruit and her cousin drunk and having sex with at least one of them at a recruiting office in Alamo Heights.

Pena was arrested by Alamo Heights police on Monday, charging him in the December incident.

“They did not wait. It was reported just after it happened the same evening,” said Sgt. Tom Vitacco, with the Alamo Heights Police Department.

Vitacco said a 19-year-old woman was with her cousin at the Navy recruiting office in the 5200 block of Broadway near closing time. He said the pair went to speak with Pena about changing her military status from active duty to reserve.

An arrest affidavit stated Pena then invited the woman and cousin, both under 21, to stay and drink alcohol.

The cousin told investigators both she and the alleged victim became intoxicated.

Police said the cousin saw Pena having sex with the newly enlisted young woman -- who was passed out -- until she began throwing up.

The cousin said when she tried to go and get help, she was involved in a drunken driving wreck on Broadway near Loop 410.

Vitacco said the incident came to light after the cousin told SAPD what had just occurred.

He said the case was turned over to Alamo Heights police since the recruiting office is in their jurisdiction.

The affidavit stated a witness claimed to have seen Pena bringing the alleged victim home and leaving her half-naked on her porch.

Police said their investigation also revealed Pena later returned to the recruiting office to removing bottles of alcohol and other evidence.

A spokesman said the U.S. Naval Recruiting Command would withhold comment due to the ongoing criminal investigation.

Vitacco said he urges other possible victims to contact Alamo Heights Police at 822-2164.

He said, “There’s always the potential for additional victims to come forward.”
