Doctor's alleged ex assault victim tells of threats

Woman claims threats made following assault in Dr. Calvin Day’s office

SAN ANTONIO - A woman who has accused dermatologist Dr. Calvin Day of sexually assaulting her during a visit to his office testified Wednesday that she was threatened after she reported the assault.

The victim, is not being identified due to the nature of the case, said that a month before she was to testify before the Texas Medical Board concerning the incident the letters "R.I.P." were painted on the front door of her home.

The board has since temporarily suspended Day’s medical license.

She said that just six or seven weeks before Day’s trial was to begin, she received a threat from a man while she visited her sister’s home.

“He said, ‘What are you trying to do, kill yourself?'" she recalled.

She said she was taken aback by the man and thought he was referring to the fact that she was walking toward the street to take out the trash.

She said the man then repeated the question, but added another sentence: “Don’t say a (expletive deleted) word.”

The woman's testimony was given during a hearing outside of the presence of a jury.

Day's lawyers asked that the testimony not be allowed because it was prejudicial to their client even though there was no direct tie made between the threats and Day.

Day is facing a maximum20 year prison sentence, if he is convicted.

Testimony will continue on Thursday in Judge Ron Rangel’s 379th District Court.
