Herrera Trial Goes To Jury

SAN ANTONIO -- Closing arguments finished early Monday and the case of a woman charged with drowning her boyfriend's 3-year-old son is in the hands of a Bexar County jury.
Veronica Herrera is accused of holding Andrew Fox's head under a bathroom faucet pouring scalding water at their Nacogdoches Road apartment in 2005.
Herrera told police she was frustrated with Fox's behavior, while her mother testified that her daughter is mentally retarded and not capable of caring for a child -- prosecutors believed differently.
"That family wants you to believe that Veronica can't even walk out of bed, can't get dressed in the morning, can't do anything," Scott Simpson said. "That just flies in the face of what you hear from everybody who is not part of that inner circle of friends and family."
Simpson also said that Herrera was capable enough to come up with a story to cover how Fox drowned, as she told paramedics he died in the apartment's pool, according to a police report.
