Parents Of Girl Killed By Truck Say University Responsible

SEGUIN, Texas -- The parents of a Texas Lutheran University student who was killed after she was hit by a pickup truck in 2004 said they were disappointed with the verdict in a civil suit they filed.
Elisa Suarez, 20, was killed after she was struck and killed by a truck while she was running on a Seguin street. Suarez was a cross country runner at the university.
Her parents filed a wrongful death suit against the university. Arturo Suarez, Elisa's father, said his daughter was not warned of the dangers of running in that area.
"It was never about money. The issue was the responsibility that the university did not take," Arturo Suarez said. "They had a lot of opportunities to prevent this accident at all times."
The jury ruled that the school bore just 5 percent of the responsibility, assigning the driver of the truck 90 percent and Elisa 5 percent.
The reaction to the verdict at the university was mixed, KSAT's Paul Venema reported. Though pleased with the fact that just 5 percent of the responsibility was assigned to the school, they expressed concern for the Suarez family.
"I think the most important thing to remember here is that of course the Suarezes suffered a terrible, terrible loss -- one that will be with them the rest of their lives," TLU spokesman Stuart Anderson said.
The 86-year-old driver of the truck was booked on charges of failure to stop and render aid, but he has not been tried due to competency issues, Venema reported.
