Teen Accused Of Shooting Baby, Mother Released From Jail

Insufficient Evidence Cited, Witness Recants Statement

A 19-year-old man was released from the Bexar County Jail on Wednesday after a witness "essentially lied," police said.

Joe Garcia was arrested on attempted capital murder charges on Tuesday after he was named in an arrest warrant in connection with the shooting of a 9-month-old baby and his teenage mother early Monday on the West Side.

The witness who helped police link Garcia to the crime is the father of the infant, police said.

The witness recanted his statement Wednesday and was "untruthful," police said.

That witness is now facing charges of perjury, police said.

Police also said that Abraham Pagan, 25, and Andre Hernandez, 21, are no longer suspects in the case.
