Asked by the prosecution whether accused wrong-way driver Jenny Ybarra was responsible for her daughter’s death, Erica Smith’s mother said, “Absolutely.”
Ybarra’s defense team in her intoxication manslaughter case has tried to share the blame with EMS paramedics who failed to attend to her dying 23-year-old daughter at the scene on Loop 410 near Rigsby.
Lisa Smith testified that on the fateful night in December 2007, she did not know the extent of her daughter’s injuries -- only that there had been a wreck.
"I started screaming and I was banging on everybody’s doors to wake up,” Smith told the jury.
Ybarra was seen wiping tears from her face as she listened to Smith’s emotional testimony.
She also cried later when her own mother, JoAnn Ybarra, testified about her daughter’s own call in the middle of the night.
“She said there had been an accident and a car had hit her,” Ybarra’s mother said.
Ybarra testified her daughter assured her she was fine, but when she asked her about the occupants of the other vehicle, she said her daughter didn’t know because the vehicle was down the road.
Police at the crash site had earlier told the jury, it was Ybarra who was going the wrong way on Loop 410. The jury has learned Ybarra’s blood alcohol content was 0.13, nearly twice the legal limit.
Ybarra’s mother said their phone call ended with her daughter saying she had to go because, “They’re going to put me in the police car.”
The prosecution has rested its case and Ybarra’s team has begun presenting its defense, including putting Ybarra on the stand tomorrow.
