The charge has been upgraded to murder for Marshall Giles, Jr., the East side man accused of hacking his father with an ax.

Giles, 19, has been in custody since shortly after the alleged attack last Wednesday. The charge against was officially upgraded from aggravated assault to murder Monday.

According to an arrest warrant affidavit, Giles called 911 late Wednesday night, telling dispatchers he had killed his father, 41-year-old Marshall Giles, Sr., with a knife.

When officers arrived, they found the father lying on the couch, moaning and bleeding profusely from large cuts all over his head, the affidavit stated.

It also stated that his left eye was hanging from its socket.

A man who was also inside the home told police, at first, that an unknown person had attacked the elder Giles, but later admitted he saw the son do it, the affidavit stated.

Officers found the son hiding in a crawl space on the side of the home and arrested him, the affidavit stated.

In the original police report, officers said Giles laughed when he found out he would be facing criminal charges.

Police say Giles Jr. told them his father had it coming for assaulting his mother several years ago.

The affidavit stated that Marshall Giles, Sr., died the morning after the attack.

Along with the upgrade in the charge against his son comes an increase in his bond. It is now set at $100,000.
