San Antonio police say they will not file any charges against the pick-up truck driver that caused an accident that killed 36-year-old Cathy Gutierrez early Sunday morning.
Police say the driver of the pick-up ran a red light and crashed into an SUV that struck Gutierrez, who was on the sidewalk.
Her husband of less than two years said it is not his heart yet to forgive that driver.
“If it was just because you didn’t want to wait at the red light, that was stupid of him,” said husband Juan Angel Gutierrez.
Gutierrez can’t help but blame himself for why his wife was killed. KSAT 12 news visited Gutierrez at his in-laws home as he made funeral arrangements for his young wife.
Looking at their engagement pictures, he wondered, “What could I have done differently that night? We could have parked in a different location walked down a different street or just not go and stay that night.”
But Gutierrez said they didn’t stay home. They decided to see the Luminaria. He said his wife had never been and always wanted to do that.
He said his wife was walking on his right and headed back to their car when in a split second he found his wife pinned between the SUV and an iron fence.
He remembered the last couple words his wife said were” baby, baby.”
With tears in his eyes, Gutierrez still can’t believe he escaped that tragic accident with just minor cuts and bruises.
He hopes people who hear this story will remember his wife as a long and beautiful person inside and out.
“She loved her family, loved her friends, she just loved to be around people… I want people to know we lost a really great person,” said Gutierrez.
Funeral arrangements have been made by her family. Her funeral mass will be held this Friday in Helotes where the couple married, and her burial will be Saturday at Resurrection Cemetery on Culebra.
