David Garza Mendoza, 73, faces charges of resisting arrest, false identification as a peace officer
A retired U.S. Marshal is out on bond after trying to reprimand an on-duty law enforcement officer.
David Garza Mendoza, 73, is facing charges of resisting arrest and false identification as a peace officer.
According to the arrest report, on Tuesday night, Mendoza was on a motorcycle and approached a Bexar County Sheriff's deputy, who was in an unmarked unit.
That's when Mendoza accused the deputy of running a stop sign. The deputy denied it and drove off.
However, the report shows that Mendoza followed the deputy into a La Quinta parking lot near Interstate 10 and Vance Jackson, took off his helmet and, in an aggressive stance, started cursing at the deputy, telling him that he was a law enforcement officer and then Mendoza displayed a Deputy U.S. Marshal Badge.
That's when the sheriff's deputy arrested Mendoza.
It turns out that David Garza Mendoza is a retired U.S. Marshal, but U.S. Marshal Robert Almonte said even if Mendoza was active duty, he shouldn't be initiating a traffic stop.
"We do not enforce traffic violations," said Almonte. "That's not part of our mission. Some of our vehicles are equipped with emergency equipment, lights and sirens, but we only use those for an emergency. An example would be arresting a fugitive."
And, no matter what the circumstances were, Almonte said Mendoza, or no one else for that matter, should be presenting themselves as an officer of the law.
"The public needs to be assured if they are approached by somebody, identifying themselves as a law enforcement officer, they need to have confidence that they are in fact law enforcement officers," said Almonte. "No one should be impersonating a public servant, a police officer, a law enforcement officer."
Mendoza was released on bond Tuesday night.
