SAN ANTONIO -

A San Antonio police officer is in critical but stable condition after being struck by a truck while working an accident scene Sunday evening.

Officer Jonathan Esquivel, 28, was placing cones at a crash site near Loop 410 and Evers when a pickup truck veered and struck him, investigators said.

The five-year veteran officer was rushed to University Hospital by EMS where he underwent emergency surgery.

According to a crash report, 40-year-old Shad Christopher Modesett told police he looked away momentarily just before the accident.

The report states that Modesett swerved to the left to avoid hitting vehicles that were slowing down.

Police are looking into whether he followed a law that requires drivers to move over one lane or slow down to 20 miles per hour below the posted speed limit.

Police said that it did not appear that Modesett was impaired.

As of Monday afternoon, no charges had been filed against Modesett.
