Photos lifted off Facebook, used in fake Instagram account

A Houston-area teen is pursuing a criminal case against the person who created a fake account using her name and likeness, and posted pornographic photos under the account.

The Katy teen, 14, said the culprit took her photos off her Facebook page, and used them to create an Instagram account.

Under the fake profile, pornographic pictures of another woman’s genitals were posted, which made it appear as though the teen had taken the photos herself.

“I was really upset and embarrassed, because I didn't want people to think it was me,” the teen said.

The teen reported the incident to her mother, who sent a barrage of emails to Instagram, requesting that they take the photos and account down. It took the social media site three days to comply.

“When she showed me the picture, the adrenaline that rushed through my body was like a torpedo,” said Patty, the teen’s mother. “And the first thing I did was say, 'We are calling the police and we are filing a report.' This can't be legal.”

According to Sgt. David Schultz with the Fort Bend County Sheriff’s office, impersonating someone on the internet is a third-degree felony, punishable by up to 10 years in prison.

“A lot of people do a lot of things on the internet that they normally wouldn't in front of somebody or in public,” said Schultz, “I can guarantee you, what you do on the internet, you will be traced and you will be caught.”

Authorities have subpoenaed Instagram for the IP address of the person responsible for posting the photos.
