SAN ANTONIO -

A hearing on a motion for a new trial for Kathleen Pierce generated a firestorm of controversy over prosecutor's tactics during the woman's January trial.

Using a search warrant prosecutors seized  a box of documents Pierce's lawyer had on his courtroom table midway through the trial.  They claimed the documents had been stolen by Pierce from her employer Newby's Hair Salons.

Pierce was accused of embezzling money from Newby's.

Her lawyer maintained that the documents were a part of his legal work product he was using to defend Pierce.

During the hearing, both sides called expert legal witnesses to testify.

On Tuesday, following often complex testimony over several weeks, Judge Raymond Angelini granted the motion for a new trial.

No trial date has been set.
