Company accused of mailing out personal info
Two people have come forward to the KSAT 12 Defenders in separate instances saying insurance companies have sent them documents with sensitive information about other people.
Both say they have tried to stop and report the mailings but have gotten limited interest from the companies themselves and state and the federal agencies charged with looking at such violations.
Gwen Gorney has received retirement account documents with the names of local school district employees from Allianz Insurance.
The documents show names, addresses, policy numbers and account balances.
"I have 251 statements on retirement accounts of these people that work at school districts," Gorney said.
They include employees from San Antonio, Northside, Schertz-Cibolo-Universal City, Northeast and Edgewood independent school districts.
Gorney has been getting them for eight years, she believes, because a now-deceased insurance agent used to live at the home where she currently lives.
She said she has done everything to stop the mailing.
"Every time I get a promise (saying) something will be done and I continue to get these papers," Gorney said. "I finally decided I was not going to let this happen to these people anymore. They don't have a clue that this is coming to me."
Fortunato Segovia is experiencing a similar situation with his own insurance company sending him documents belonging to others.
"I'm like, 'I can't believe this,'" Segovia said.
He said Chubb Insurance sent him documents with even more sensitive information than that sent to Gorney.
"Medical diagnosis, social security numbers, addresses, phone numbers,” Segovia said. “They sent me over 15 to 20 documents."
He too was frustrated that no agency seemed to want to take his complaints seriously.
The Texas Department of Insurance regulates the insurance industry and can impose sanctions on companies the violate the rules.
However, TDI would only issue a statement via email about these incidents.
It said, “regarding Mr. Segovia's complaint, TDI did not receive any conclusive information demonstrating that a violation occurred.”
They say they are still looking into Gwen Gorney's complaint.
Gorney's papers were taken to TDI for use in their investigation.
Meanwhile, Segovia disagrees with the TDI’s findings, and said what happened to him was definitely a violation.
