Devine medical supply company owner sentenced to 27 years in federal prison

Daniel Thomason Smith convicted in $3.5M health care fraud scheme

SAN ANTONIO – The owner of a medical supply company in Devine was sentenced Thursday to 27 years in federal prison in connection with $3.5 million health care fraud scheme.

Daniel Thomason Smith, owner of DTS Medical Supply Co., must also pay $3.2 million in restitution and will be on supervised release for three years after completing his prison term, federal officials said in a news release.

Smith was found guilty in June 2016 of conspiring to submit numerous false and fraudulent benefit claims to Medicaid and Medicare seeking compensation for powered wheelchairs between May 2006 and January 2010, federal officials said.

Smith hired Robin Renee Haigler, a defendant, on a commission basis to recruit customers primarily in the Waco area, federal officials said.

Another defendant, Kathleen Marina Kelly-Tuorila, used the customer information from Haigler to generate and submit fraudulent claims for reimbursement to Medicaid and Medicare for powered wheelchairs, federal officials said.

Haigler, 60, was sentenced in November 2016 to seven years in federal prison.

Sentencing for Kelly-Tuorila has yet to be scheduled.
