A former Judson ISD kindergarten teacher convicted of having her students line up and slap a disruptive student has been granted a new trial.
The attorney for 44-year-old Cynthia Ambrose tells KSAT 12 Bexar County District Judge Sid Harle granted Ambrose a new trial due to a error in the jury charge.
The jury was not notified about a particular rule regarding a witness which led to Judge Harle's decision to grant a new trial. A date for the new trial has not been set.
Ambrose was sentenced to 30 days in jail and two years on probation after she was found guilty of official oppression in June.
According to testimony in the first trial, Ambrose was called in to assist another teacher who was having disciplinary issues with a kindergarten student.
Ambrose then instructed seven of her students ranging in age from four to six years old to line up and take turns striking the student, trial testimony revealed.
