Joseph Rodriguez, an ex-city councilman with the city of Castle Hills, is accused of impersonating a peace officer by trying to use his former title to intimidate police officers.

Rodriguez, 51, was arrested Friday in connection with the Jan. 19 incident that also led to charges against his 23-year-old son, Justin.

Capt. Johnny Siemens, with the Castle Hills Police Department, said that officers attempted to stop a vehicle in which Justin Rodriguez was riding, but he refused to cooperate with them.

"The passenger became unruly, fighting the officers, (and) at one point, head-butting an officer," Siemens said.

According to an arrest warrant affidavit, the vehicle stopped only after it reached the driveway of the Rodriguez home, and Justin Rodriguez (pictured below) then pointed out to officers that he was on private property and they had to leave him alone.

The affidavit stated that at one point during the commotion, Joseph Rodriguez came out of the home and tried to verbally strong-arm the officers into letting his son go.

"(He was) threatening to have their jobs,” Siemens said. “Also purporting to be a councilmember, a current councilmember."

The officers involved did not know at the time whether Rodriguez, whose term ended in 2006, was a current councilmember, he said.

Siemens said the officers called him and the police chief in the middle of the night to apprise them of the situation.

However, he said, the law applies to everyone, regardless of title.

“Whether it's a police officer or an elected official, (there's) no difference at all,” Siemens said.

Detectives spent several weeks investigating the case before they obtained a warrant for Joseph Rodriguez’s arrest.

He was booked into the Bexar County Jail Friday on a charge of impersonating a peace officer.

His son, Justin Rodriguez, was taken into custody at the time of the incident on a charge of assault on a public servant.

However, Siemens said the investigation is not over yet, and additional charges could be forthcoming.
