Some neighborhood associations to enforce fireworks violations

HOAs could impose fines on violators

SAN ANTONIO – Despite the fact that it’s illegal to pop fireworks within the city limits, it’s not uncommon to see and hear them in neighborhoods across San Antonio.

In fact, there are so many violators, that San Antonio police and firefighters couldn’t possibly respond to all of the complaints. So, residents in a couple Northwest side subdivisions are taking it upon themselves to enforce the rules.

The president of the neighborhood association in Creekview Estates and Creekview Forest has posted messages online warning residents that popping fireworks is against homeowners’ association rules, and they plan to enforce a $250 fine to anyone who violates those rules.

The post instructs residents to “write down the address of the violator(s)” and submit the information to the management company. A sign posted in the neighborhoods warns that violators will be fined per incident.

These two neighborhoods aren't unique in banning residents from using fireworks. Some neighborhood associations specifically address fireworks in the binding documents that residents must agree to when purchasing a home within the association.

Of course, if the neighborhood is within the San Antonio city limits, it's also against the law to pop them.

If a violator is caught by a San Antonio police officer, the penalty could be much higher than a fine imposed by an HOA. The use of fireworks in the City of San Antonio is a Class C Misdemeanor, which can carry a fine of up to $2,000.

The San Antonio Fire Department will have a fireworks hotline on July 4 to take calls about illegal fireworks within the city limits. The number is 210-207-0202.
