A former patient of dermatologist Dr. Calvin Day testified that Day kissed her and groped her below the waist during a July 2009 office visit.
But on cross examination from Day’s attorney, Jay Norton, the woman had difficulty remembering specific details.
In a previous statement, the woman said that after Day had kissed her strongly and touched her pubic area she asked him to stop.
“After you say he stopped, do you recall saying, 'He looked at me -- turned back around and looked at me -- and said ... he said he’d like to have oral sex?'" Norton asked.
“He did say that, yes,” the woman replied.
Norton said she never mentioned that in her previous statements.
The prosecution rested their case in the punishment phase of Day’s trial early Wednesday afternoon.
The defense began calling witnesses from a long witness list. They say they’ve not decided whether Day will be among the witnesses they plan to call.
The jury could sentenced Day up to 20 years in prison, but he is eligible for probation since he has no criminal record.
He must, however, register as a sex offender for the rest of his life.
Testimony will continue on Friday in Judge Ron Rangel’s 379thg District Court.
