SAN ANTONIO – Rene Moreno, 27, was on his way home to San Antonio following a party in Boerne when his pickup slammed head-on into a small sedan driven by Ashlee Fleming.
According to testimony in the punishment phase of his trial on intoxication manslaughter charges, Moreno was going the wrong way on Interstate 10.
The first person on the scene of the early morning wreck on Sept. 12, 2010, was Scott Foulke, an off-duty San Antonio Police Department motorcycle officer.
"From the time it happened, until the time I was off my motorcycle in the scene itself, was about 60 seconds," Fouke testified.
He first checked on Fleming, 19, and said it appeared she had been killed instantly.
He said he then moved to check on Moreno, who was driving a small pickup truck.
He said Moreno was conscious and complained of leg injuries.
Foulke said as he tried to pry Moreno from his truck, he could smell alcohol.
"His general demeanor was what I would call a 'stuperous look,'" Foulke said. "His face was flushed and his eyes were glassy and a little bloodshot."
Moreno was taken by medical helicopter to an area hospital where his blood alcohol level was tested. It was more than twice the legal limit.
At the outset of his trial, he pleaded guilty to intoxication manslaughter charges.
He is facing a maximum sentence of 20 years in prison but because he has no criminal record, he is eligible for probation.
Testimony will continue on Thursday in Judge Sid Harle's 226th District Court.
