2 more young victims added to child sex assault case; Josue Delgado re-indicted

SAN ANTONIO – There are new allegations in a child sex assault case KSAT 12 been following for almost a year.  

Army Reservist Josue Delgado was indicted March 15 for two new allegations of continuous sexual assault of a child. That brings the total number of alleged victims to three. A family member of the first victim wants justice for all the families involved. 

Feelings of betrayal bring up painful emotions for Eddie. KSAT is not releasing the relatives last name to protect the identity of the victim.

"He lived with us for many years," Eddie said.

He said he and his wife helped support family friend Josue Delgado for 17 years. Then last April, Delgado was arrested and charged with continuous sexual assault of a child. That child ended up to be one of Eddie's young relatives. 

"We brought him in here not even thinking or suspecting something like this could happen," he said, his eyes welling with tears. 

A year after the arrest his burden grows heavier. On March 15, the Bexar County Criminal District Attorney's Office added two more young victims to Delgado's case, and he was re-indicted. 

Eddie spoke with KSAT after the first charge, asking other possible victims to come forward.

"Other people recognized who it was and they came forward and said, 'He did that to me too. He did that to me 15 years ago.' Several people have come forward," Eddie said.

In late April, Universal City police, who arrested Delgado, confirmed there were two to three more victims who had come forward, claiming Delgado sexually abused them too. Detectives confirmed a couple of the victims are now adults and say the alleged assaults happened when they were kids. 

The topic is tough for Eddie but he says if there are more victims, talking about what happened is the best thing to do, especially while time ticks towards an eventual trial. 

"Anybody that's come forward, I want to applaud them and thank them for coming forward. It's a stigma and no one wants to talk about it but it empowers other people that are watching the news, 'You know what that happened to me so I think I'm going to come out too.' And I think people should know," he said. 

Delgado is now waiting for his day in court. The trial date has not been set yet and he is still at the Bexar County Jail. Anyone who wants to make a report can call the District Attorney's Office at 210-335-2311.

As for the statute of limitations for sexual assault in Texas, it depends on the case.

There is no statute of limitations for certain situations, including:

  • Continuous sexual abuse of young children
  • Probable cause that the defendant has committed the same or a similar sexual offense against five or more victims.
  • Human trafficking is involved.

Sexual assault cases where these specifications don't apply, have a limitation of 10 years.
