SAN ANTONIO -

A man whose criminal record already includes a sexual assault arrest has been arrested on the same charge. Sergio Martinez was taken into custody Monday.

An arrest warrant affidavit stated that Martinez's accuser this time is a 38-year-old woman who told police it happened after she accepted a ride from him.

The affidavit stated that the woman reported the alleged attack in June 2012.

She told detectives she had had too much to drink during a night out, then accepted a ride from Martinez, whom she met through a friend, the affidavit stated.

The woman said after driving a short distance, Martinez pulled over and stopped, threw her on a bed inside his tractor trailer and sexually assaulted her, the affidavit said.

She told police she blacked out during the alleged attack, but underwent a rape exam at a hospital the next day, the affidavit stated.

Police said they obtained a DNA sample which they entered into a computerized database, and it matched Martinez's sample which was in the system already, the affidavit stated.

Records show Martinez was arrested in 2004 on a charge of sexual assault stemming from a different case. He also faces a sexual assault charge this time.
