A San Antonio attorney facing allegations of fraud has more legal problems.
Hilda Valadez, 52, was arrested on Monday and charged with driving while intoxicated and having an open container in her car.
Valdez' attorney, George Scharmen, said his client was in the 13900 block of Blanco Road waiting alongside her car waiting for a wrecker when an officer approached and asked if she had been drinking.
"She had been there, I don't know how long, at least 45 minutes" Scharmen said. "I don't know what prompted the officer to do a DWI investigation but she really was cooperative."
Scharmen said faulty equipment in the magistrate court prevented officers from doing a breath test that Valadez had offered to perform.
She did give a blood sample.
"We think that the alcohol concentration is going to be, if not zero, (then) very low," Scharmen said.
He said he also plans to have Valadez's blood tested by an independent lab.
Valadez is due in district court on May 20 on another matter.
She is facing 46 counts of fraud for allegedly forging judges' signatures and double billing the county in cases of indigents whom she represented.
