The affidavit stated that a 12-year-old girl made the outcry to San Antonio police Monday, accusing Najera of having sexual intercourse with her in August and touching her inappropriately since she was 9-years-old.

The affidavit also stated that she had made a similar complaint in March of 2012. But police had to close the case when she failed to follow through, the affidavit stated.

The girl's mother also spoke to police Monday, telling detectives that her daughter "is a liar" and made up the story so that Najera would be deported to Mexico, the affidavit stated. The mother also accused the 12-year-old of flirting with Najera, the affidavit stated.

Detectives said, under questioning, Najera admitted to sexually assaulting the girl, the affidavit stated.
