Same-sex divorce, custody proceedings on hold

Emergency stay granted by Texas attorney general


Divorce and child-custody proceedings for a same-sex couple living in San Antonio are back on hold after a decision by a Texas appeals court.

The couple was legally married in Washington DC in 2010 but filed for divorce in Bexar County back in February.

On Tuesday, a state district judge ruled the divorce case could continue because the Texas ban on same-sex marriage violated the U.S. constitution.

But on Wednesday, Attorney General Greg Abbott asked the Fourth Court of Appeals to grant an emergency stay.

An attorney for one of the women confirmed that the court agreed to that request Thursday afternoon.
