The documents state that Duncan at first told police investigators he was giving 11-month-old Rubi Lynn Duncan a bath when he left her briefly to get some clothes for her.

He told police he panicked and called the baby's mother instead of seeking help. Rubi's mother would be the one to call police after finding her unresponsive in her crib.

When police arrived, they found a bag in the bathroom with cocaine, crystal meth and heroin.

Later, investigators found on Duncan's phone that he was trying to arrange a drug deal.

Duncan is now charged with injury to a child causing serious bodily injury by omission.

He was already previously charged with possession went intent to deliver. His bond has been set at $150,000.

Rubi Duncan would have turned 1 year old June 12.
