Rules and Regulations
PERIOD: Contest begins at 1:00 pm Central Time (CST) on November 19, 2014 and ends at 1:59 pm CST on December 3, 2014 ("Entry Period").
ELIGIBILITY: Contest is open to legal United States residents at the time of entry ("Entrant"). If Entrant is under the age of 18, Entrant must have a parent and/or guardian's permission to enter. KSAT ("Sponsor"), Cirque Productions and their respective immediate family and/or household members, sponsors, employees, subsidiaries, affiliates, directors, officers, employees, advertising and promotional agencies, are ineligible to participate. Contest winner MUST be available to attend the performance on Sunday, December 14th for the 7pm show.
ENTRY: Limit one (1) entry per Entrant. Eligible entrants should visit www.salive.com, fill out the entry form with all necessary information and upload a link to a YouTube video that illustrates Entrant's special talent (i.e. singing, dancing, juggling, etc). Videos must be no longer than two (2) minutes in length. Entrant must have permission from any person appearing in the video to use their likeness in this contest. The video must be original, unpublished and the sole property of Entrant. Sponsor in its sole discretion may post the submitted videos on any owned or operated websites provided that the video does not contain lewd, inappropriate, threatening or obscene, defamatory or libelous images or content. In addition, by submitting a video, Entrant agrees that the video does not infringe on the intellectual property or other rights of any third party, does not violate any laws, nor does it contain a virus. By Submitting an Entry, Entrant hereby grants permission for the Entry to be posted on any and all Sponsor. owned or operated media platforms and/or websites (including, but not limited to, TV, Internet, Twitter account or Facebook).
SELECTION OF WINNER: The cast of Cirque Dreams Holidaze will select the winner on December 3, 2014 based on the criteria of creativity and originality. The potential winner will be notified, by e-mail, and/or telephone. To be awarded the prize, Failure of the potential prize winner to respond within a reasonable time frame (but not longer than 24 hours) from such notification referred to above may result in disqualification and the selection of another entrant from among all eligible entries received. Sponsor is not required to contact potential prize winner more than once. In the event of non-compliance for any reason, including the inability to accept the prize for any reason, an alternate entrant may be selected in Sponsors sole discretion.
PRIZES: Grand Prize – winner will have the opportunity to win a featured role when the show performs at the Tobin Center Dec 11 – 14 and four complimentary tickets to the Sunday, December 14 performance. Prizes consist of only those items specifically listed as part of the prize. No substitution or transfer/assignment of prize by winners permitted. Subject to all terms, conditions and restrictions on face of gift cards or imposed by issuer. If by reason of printing or other error, more prizes are claimed than the number of prizes set forth in these Official Rules, a random drawing will be held to award the advertised number of prizes in the relevant category. Under no circumstances will more than the advertised number of prizes be awarded. Prize is awarded "AS IS." Winner must arrange their own transportation to/from the theater and be available for rehearsals December 14. Federal, state, and local taxes on prizes, if any, and any other costs, fees and expenses not listed above as specifically included as part of the prize are the sole
responsibility of winner. ALL TAXES ARE THE SOLE RESPONSIBILITY OF THE WINNER. An IRS form 1099 and other tax-related forms and documents may be issued by Sponsor if required by law.
CONDUCT: The Official Rules will be posted at the Contest Sites throughout the Entry Period. By entering and participating in this Contest, entrants (a) fully and unconditionally agree to be bound by these Official Rules and by all decisions of the Sponsor (which decisions shall be final and binding in all respects), including without limitation decisions regarding eligibility, prize winner(s )and the interpretation of terms used in these Official Rules; and (b) represents and warrants that all information provided by entrant in connection with the Contest is true, accurate and complete. The Sponsor reserves the right, at any time and in its sole discretion, to disqualify and/or deem ineligible to participate in this Contest or any future contest or other promotions of the Sponsor, any individual it suspects: to be tampering with the entry process or the operation of the Contest or the Contest Site; to be acting in violation of the Official Rules or the Contest Site's terms of service, privacy policy or other terms, conditions or guidelines; to be acting in bad faith or in a disruptive manner, or with the intent to annoy, abuse, threaten or harass any other person; to have failed to agree to these Official Rules; or to be in violation of these Official Rules. Any attempt by an entrant or any other individual to deliberately damage any internet site or undermine the legitimate operation of the Contest is a violation of these Official Rules as well as criminal and civil laws. Should the Sponsor believe or become aware that such an attempt has been, is being, or will be made, the Sponsor reserves the right to seek remedies and damages from any responsible entrant(s) and other responsible individual(s) in the attempted damage to the fullest extent permitted by law, including without limitation criminal prosecution.
RELEASE AND INDEMNIFICATION: By entering the Contest, entrants release and hold the Sponsor, and any affiliated entities including parents, related and affiliated companies, subsidiaries, advertisers, promotional agencies and each of their respective directors, successors, sponsors, partners, licensees, officers, subsidiaries, agents, employees, artists, advisors, assignees, and all others associated with the development and execution of the Contest harmless from and against any and all losses, damages, rights, claims, and actions of any kind arising in whole or in part, directly or indirectly, from the Contest or participation in any Contest-related activity, or resulting directly or indirectly, from acceptance, possession, use, or misuse of any Prize awarded in connection with the Contest, including without limitation causes of action, claims and demands, including legal fees and expenses, including but not limited to, claims based on negligence, breach of contract and liability for physical injury, death, or property damage which the entrants or his/her administrators, heirs, successors or assigns might have or could have, by reason of or arising out of the entrant's participation in the Contest and/or in connection with the acceptance and/or use entrant of the Prize. The Contest is in no way sponsored, endorsed, administered by or associated with, Facebook and all entrants agree to release and hold harmless Facebook from any and all liability associated with or arising out of the Contest.
OTHER TERMS: Sponsor not responsible for any typographical or other error in the printing, the offering or the announcement of any prize or in the administration of the promotion, whether caused by computer, technical or human error. Sponsor is not responsible for late, lost, damaged, incomplete, illegible, faulty, or incorrect transmissions, incorrect announcements of any kind, technical hardware or software failures of any kind, any damage to any person's computer related to or resulting from participating in the online portion of the promotion, lost or unavailable network connections, or failed, incomplete, garbled or delayed computer transmission that may limit a user's ability to participate in the promotion whether caused by computer, technical or human error. Sponsor reserves the right to cancel or modify the promotion or any portion of it for any reason, including but not limited to, if fraud, misconduct or technical failures destroy the integrity of the promotion; or if a computer virus, bug, wireless failure, or other technical problem corrupts the administration, security, or proper administration of the promotion as determined by Sponsor, in its sole discretion. Sponsor reserves the right to disqualify,freeze or prohibit the participation of an individual if fraud or tampering is suspected, or if the individual fails to comply with any requirement of participation or with any provision in these Official Rules. Any attempt to undermine the operation of this promotion is a violation of criminal & civil laws. Sponsor reserves the right to disqualify and/or seek damages from any individual making any such attempts to the full extent permitted by law.
LIMITATION OF LIABILITY: The Contest, all Prizes, and all materials provided on or through the Contest Site are provided "as is" without warranty of any kind, either express or implied, including without limitation the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
WITHOUT LIMITING THE RELEASE GRANTED BY ENTRANTS HEREIN, BY ENTERING THE CONTEST, EACH ENTRANT AGREES THAT TO THE EXTENT PERMITTED BY APPLICABLE LAW: (1) ANY AND ALL DISPUTES, CLAIMS AND CAUSES OF ACTION ARISING OUT OF OR CONNECTED WITH THE CONTEST, OR ANY PRIZE AWARDED, WILL BE RESOLVED INDIVIDUALLY, WITHOUT RESORT TO ANY FORM OF CLASS ACTION; (2)UNDER NO CIRCUMSTANCES WILL ANY ENTRANT BE PERMITTED TO OBTAIN ANY AWARD FOR, AND ENTRANT HEREBY KNOWINGLY AND EXPRESSLY WAIVES ALL RIGHTS TO SEEK, PUNITIVE,INCIDENTAL, EXEMPLARY, CONSEQUENTIAL OR SPECIAL DAMAGES, LOST PROFITS, AND/OR ANY RIGHTS TO HAVE DAMAGES MULTIPLIED OR OTHERWISE INCREASED; AND (3)ENTRANT IRREVOCABLY WAIVES ANY RIGHT TO SEEK INJUNCTIVE OR EQUITABLE RELIEF. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY, SO THE ABOVE MAY NOT APPLY TO YOU.
GOVERNING LAW: The Contest and these Official Rules are governed by and shall be construed in accordance with the substantive laws of the State of Texas and the United States of America applicable to contracts made and performed entirely in Texas. All applicable federal, state, and local laws and regulations apply.
AWARDING OF THE PRIZE: Winner must claim the prize in person and must present proper identification in order to receive winnings. Odds of winning depend upon the total number of eligible entries received.
