Bexar investigators await toxicology results in fatal crash

Woman allegedly to blame for crash yet to be arrested

BEXAR COUNTY, Texas – A 58-year-old man was killed and 7-year-old from Floresville was hospitalized for more than a week after a wreck that happened along Highway 181 on Nov. 24.

Angel Castillo was riding in his grandfather's car when it was hit from behind, killing Peter Castillo.

Bexar County sheriff's investigators said they suspect the driver responsible had been drinking, but that woman has yet to be arrested.

"We have to make sure people are guilty of a crime before they're charged with a crime and put in jail," said James Keith, with Bexar County Sheriff's Office.

The sheriff's office is awaiting toxicology results to determine if the woman was under the influence.

When the signs of drunk driving are not obvious to investigators, drivers can sometimes go free until there's proof of wrongdoing. Even when drivers are arrested, they aren't immediately prohibited from getting back on the road.

"A lot of that is going to be determined by the judicial system," Keith said. "In many cases it's our deputies' responsibility to get that person off the streets. They go through the justice process after that."

Going through takes process time. And in the case of this crash, that's what investigators need more of.

"People are hurt. People have emotional wounds in addition to the physical wounds. And we understand people want closure," Keith said. "But we have an obligation to make sure that justice is served. We're going to make sure its served in this case. But unfortunately for the family and victim, it's going to take us some more time."
