Federal judge: No gay marriage in Texas until appeals ruling

SAN ANTONIO – A local federal judge has declined to allow gay marriages to take place in Texas while the state awaits a ruling from the Fifth Circuit Court of Appeals.

U.S. District Judge Orlando Garcia filed that order Friday morning.

Attorneys for two same-sex couples who are suing the state for the right to marry legally in Texas had argued that couples should be allowed to marry while their cases are making its way through the system.

In February, Garcia ruled the ban is unconstitutional, but then granted a stay. That means everything continues to stay in place as it works its way through the courts.

The appeals court is expected to hear the case in January.
