Man arrested, charged with photographing girl, 11, in New Braunfels Walmart bathroom

Hermes Estuardo Mendez, 36, charged with possession of child pornography

NEW BRAUNFELS, Texas – A man accused of photographing a girl, 11, inside a Walmart bathroom has been captured after more explicit photos were found on his phone.

On Aug. 12, New Braunfels police were called to the Walmart in 1200 block of Interstate 35 after a girl told her parents someone took a picture of here under the bathroom stall.

When police arrived, Hermes Estuardo Mendez, 36, was still in the women’s bathroom. He was arrested on two outstanding warrants that night.

He was later released as police continued their investigation, which determined that Mendez also had images of a 5-year-old girl on his cellphone.

A warrant was issued for his arrest on Nov. 1 and he was finally arrested by the Lone Star Fugitive Task Force on Tuesday.

He remains behind bars with bails totaling $200,000 and additional charges could be filed.

Police suspect there maybe additional victims -- including at least one adult victim -- who were in the back bathroom of the store that day between the hours of 8 p.m. and 9:30 p.m.
