SAN ANTONIO – San Antonio police arrested a 53-year-old convicted sex offender who is facing a new charge of raping a woman after threatening to a kill her if she didn't have sex with him.

The man is identified as Gary Devaughn, who is now being charged with sexual assault.

In a police report released to KSAT.com, a 23-year-old woman said she had been staying with friends at a home for several nights when Devaughn showed up Sept. 16 around 11:30 p.m. to hang out.

The victim told police Devaughn had made numerous sexual advances toward her, to which she said she had repeatedly denied. She told police she went to bed that night but the next morning, Devaughn threatened to kill her if she didn't have sex with him.

Devaughn told the victim, "The only way you're getting away from me, is by killing me or leaving the city," according to the police report.

Fearing for her life, the victim told police she "gave in" and that's when Devaughn raped her until one of her friends heard her crying.

The friend told police she witnessed Devaughn punch the victim in the face when she said, "You just raped me," according to the police report.

Police said Devaughn was chased out of the house by another friend in the home and took off before officers arrived. He was later taken into custody at an East Side home located in the 900 block of H Street.

A sexual assault nurse examination, or SANE, was administered for both Devaughn and the victim, the police report stated.

According to online records, Devaughn was convicted for aggravated sexual assault on a 22-year-old woman in 1990 and served seven years in prison.

That conviction led to Devaughn being required to register as a sex offender annually for life, according to online records.

Online records show Devaughn has an arrest record that dates back to 1997, shortly after he was released from prison.

Devaughn was previously convicted for assault, possession of a controlled substance and terroristic threat.

He was arrested two years ago for a charge of attempted sexual assault but the case was later dismissed due to a missing witness.

Devaughn was also arrested twice, in 2011 and 2016, for failing to register as a sex offender. Those cases were also later dismissed.

Devaughn is now being charged with a second-degree felony. His bail has been set at $50,000.
