Man accused of sexually assaulting child when she was 13

John Anthony Rodriguez, 26, facing charge of aggravated sexual assault of child

SAN ANTONIO – A 26-year-old man was arrested on suspicion of sexually assaulting a girl two years ago when she was 13 years old, court documents state.

John Anthony Rodriguez was taken into custody after the victim, now 15 years old, told investigators Rodriguez assaulted her at least four times.

According to court documents, Rodriguez had been staying where the girl lived and allegedly assaulted her when her family was sleeping.

An arrest affidavit states the victim fought Rodriguez's advances by biting him. When the assaults continued, the affidavit states she threatened to report him and he would never be able to see his child again.

Rodriguez eventually moved somewhere else.

When police interviewed Rodriguez, an affidavit said he claimed the sex was consensual and occurred once.

Rodriguez faces a charge of aggravated sexual assault of a child.
