'I blacked out': Man chokes girl, 14, before shoving her inside closet, BCSO says

SAN ANTONIO – A man is facing a third-degree felony after investigators said he choked a teen girl to the point where she blacked out during the assault, and then threw her inside a closet.

The Bexar County Sheriff's Office identified the man as Roy Smith, 51.

A BCSO investigator said in an arrest affidavit deputies were called Monday to the Children's Hospital of San Antonio, where a nurse was treating a girl, 14, for injuries.

The nurse told the investigator that the girl had a "fine red mark to (her) jawline, red linear lesion and fine linear marks on (her) neck," the affidavit stated.

At the hospital, the victim told the investigator she couldn't breath when Smith began to choke her, which led her to black out, according to an arrest affidavit.

The victim said Smith then "threw me to (sic) the closet" and also "threw a glass tray at my dog," according to the affidavit.

"My neck started hurting really, really bad and then everything went blank," the victim said.

Smith is now being charged with injury to a child, a third-degree felony.

His bail has been set at $15,000.
