Child who witnessed fatal shooting pins crime on "Papa Jim," affidavit says

SAN ANTONIO – The family of Gary Davila came together Tuesday night to remember a man they said was taken too soon.

The vigil was held on the same day San Antonio police announced an arrest has been made in the fatal shooting. Davila’s parents said the arrest brings some closure.

"I'm happy he's caught,” Janie Davila said. “I'm happy. He's going to pay for what he did to my son."

Hours earlier, police arrested Jim Garcia Longoria, 69, and charged him with the killing of Gary Davila.

The family said Longoria came to their home on Five Palms Drive and accused their son of stealing and an argument broke out.  

“I think he wanted to kill my son right there and then," Martin Davila said.

Longoria left, but when he returned hours later police said he drove up to the victim on Jan. 15 and shot him in the neck.

"He could have driven away, you know,” Martin Davila said. “He didn’t have to take the life of my son."

According to an arrest affidavit, the child inside the car at the time of the shooting placed the gun in Longoria’s hand. The boy told police “Papa Jim” was the trigger man, the affidavit said.

Now the victim’s family said they hope Longoria tells police what happened. As of Tuesday night, Longoria was still being magistrated and charged with murder, his bond is $100,000.
