Family of man killed by SAPD officer settles lawsuit with Chacho's

'Confidential settlement' reached with restaurant

SAN ANTONIO – The family of a man killed by a San Antonio police officer in 2014 reached a deal in a civil suit against the restaurant that hired the off-duty officer who shot him.

Marquise Jones was killed by Officer Robert Encina in February 2014 outside the Chacho's in the 8600 block of Perrin Beitel.

Police have said Jones was a passenger in a car involved in a minor accident in the restaurant's parking lot. Encina was working security and went to investigate the incident. He has said he believed Jones had a gun when he ran from the scene. The officer fired, killing Jones.

Family members have disputed Encina's version of the shooting, which was upheld by a Bexar County grand jury in December 2015. A no-bill was issued, clearing the officer of any possible charges.

The Jones family filed a federal lawsuit against Encina, the City of San Antonio and Chacho's restaurant.

Court papers filed Friday said the family had reached a "confidential settlement agreement" with Chacho's after mediation.

The document also said the Jones family has "reinitiated discussions around the scheduling of depositions" with the city and Encina.

A scheduling hearing is scheduled for later in January.

The family is also hoping District Attorney Nico La Hood will have a different grand jury review the case, but he has said that would only happen if new evidence became available.
