Police said that Amezquita told them that the homeowner, Kerry O’Toole, 53, answered the door agitated and kicked and choked him.

Amezquita told police that he went to his vehicle and got a handgun and shot O’Toole because he was throwing rocks at him, police said.

Amezquita left the scene and called 911. He was arrested nearby and told police he shot O'Toole in self-defense, police said.

Police didn't believe Amezquita and charged him with murder.

Amezquita is currently awaiting trial.
