No indictment for 2 Bexar deputies in fatal shooting

SAN ANTONIO – A Bexar County grand jury voted Wednesday not to indict the two Bexar County sheriff's deputies who fatally shot Gilbert Flores on Aug. 28.

The deputies, Greg Vasquez and Robert Sanchez, shot Flores in the 24400 block of Walnut Pass while responding to a domestic disturbance report.

When the deputies arrived, they found a woman with cuts to her head. She was holding a baby who also appeared to be injured, according to the Sheriff's Office.

The deputies said they tried to arrest Flores using non-lethal force, but were unsuccessful with their Tasers. The Sheriff's Office said Flores showed a knife right before he was shot.

Vasquez and Sanchez were placed on administrative leave after the shooting.

Cellphone video obtained exclusively by KSAT 12 News appeared to show Flores raising his arms in surrender just before the fatal shots were fired.

Bexar County Sheriff Susan Pamerleau held a press conference Wednesday to address the grand jury decision.

"Decisions that are made by those who wear the badge are often scrutinized, and we recognize that that comes with the job," she said. "However, when a deputy makes a decision to use deadly force, we have an obligation to investigate that decision thoroughly. And that's exactly what's been done in this case with deputies Sanchez and Vasquez."

She said a second video, 911 calls and radio calls helped investigators during the investigation. Those recordings will be made available, Pamerleau said.

"Sometimes if you see only a video, but you don't have sound, you don't have the context of what had gone before or after it, it can often lead to a different conclusion," Pamerleau said.

Thomas J. Henry, the attorney for the Flores family, said Wednesday's decision is "just one legal step" and that the family is still planning on pursuing its civil lawsuit against the Sheriff's Office and Bexar County.
