SAPD releases report on fatal Chacho's shooting

SAPD report: Fabian Garza arrested on outstanding warrants, began incident in drive-thru

San Antonio police have released new information about a fatal officer-involved shooting at Chacho's and Chalucci's on the Northeast Side.

According to a police report released Wednesday, 21-year-old Fabian Garza rear-ended a SUV last Friday in the drive-thru of Chacho's in the 8600 block of Perrin Beitel Road and then attempted to flee the scene. 

A witness alerted SAPD Officer Robert Encina, who was working off-duty at the restaurant, of the incident.

The report stated Encina approached Garza and asked him to get out of the car, but he and his passenger, Marquise Jones, were not complying with Encina's orders.

As Encina was attempting to detain Garza, Jones got out of the vehicle and began to pull a revolver from his waist area.

Encina then opened fire and shot Jones, who collapsed a short time later and died at the scene, according to the report.

Encina was placed on administrative duty pending an investigation. Garza was arrested for three active municipal court warrants, according to the police report.

KSAT recently learned that since Jan. 5, 2013, there have been more than 130 calls for police service at the Chacho's and Chalucci's on Perrin Beitel Road.
