SAN ANTONIO – The lone survivor of a shooting that claimed the life of her mother and sister was grilled extensively by defense attorneys on Tuesday.
Candice Moten, 25, denied suggestions from Defense Attorney Joel Perez that her mother, Laura Moten, 46, and her sister Krystel Moten, 23, attacked her boyfriend James Morrison.
Prosecutors said Morrison shot all three woman during a heated domestic disturbance outside the women's Northeast side apartment on the night of April 18, 2009.
Morrison is on trial, facing a charge of capital murder.
He claimed it was self-defense, insisting that the three attacked him after accusing him of slashing the tires on Laura Moten's car.
"He shot us, period," Candice Moten testified.
She said that after Morrison fired several shots her mother shouted obscenities at him.
"She yelled at him and he came back and shot more," Moten testified.
If the jury finds Morrison guilty of capital murder, prosecutors have indicated they will seek the death penalty.
Testimony will continue on Wednesday in Judge Ron Rangel's 379th District Court.
