A young father plead no contest Wednesday to charges that he killed his own son last summer.
Justin Janosik was facing capital murder charges, but as part of a plea agreement he was sentenced to life in prison in exchange for his plea to the charge of murder.
Janosik was arrested last July after paramedics answered a call at his grandparents home where he lived with the mother of his 22-day-old son, Kaleb.
"The baby had a fractured skull and a lot of bruising to the back of his head, which is consistent with the (Janosik's) account of punching the baby," said Prosecutor Michael De Leon.
In his confession, Janosik admitted striking the child.
"The explanation to the police was (that he had a) crying child ... (and that the child's) mother can't get sleep (and) he loves her, so that was his remedy," said Defense Attorney Vincent Callaghan.
If he had been convicted of capital murder, Janosik was facing a punishment of life without the possibility of parole or execution.
His life sentence on the murder charge means he will be eligible for parole in 30 years.
