Testimony begins in student's murder trial

New Braunfels Canyon High School student charged in death of Logan Davidson, 16

NEW BRAUNFELS, Texas – Among the first witnesses for the state in the trial of a 16-year-old Canyon High School student accused of killing a fellow student was a teenager who described the victim, Logan Davidson, 16, as his best friend.

Because they are juveniles, neither the defendant nor the witness is being identified.

The first student to testify Tuesday morning told how he heard the teen on trial shout at Davidson as they exited their first-period chemistry class on the morning of Nov. 12, 2013.

"I heard (the defendant) say, 'Come here you little (expletive),'" the teen testified. "He went after Logan and punched him in the face and then punched him again before Logan could put up his hands in defense."

He said Davidson (pictured) fell back and struck his head against the wall.

The student's chemistry teacher, Wayne Migura, testified that he heard a disturbance outside his classroom as students exited to change classes.

"I saw Logan lying on the floor looking pale, with blood coming from his mouth," Migura testified. "It made me sick."

The lawyer for the teen on trial, Joseph Garcia, described the case as a tragedy.

"It is just a terrible tragedy all around," Garcia said.  "I hate to even try the case, but we have to."

If he is found guilty, the teen could be facing a maximum of 40 years in prison.  The case is still in the juvenile system and if he is found guilty, it would be re-visited when he turns 19 for what is called determinant sentencing.
