District Judge William Crawford II said he needs more time to research whether prosecutors filed the case in the wrong county as well as other issues. Emergency managers who were appointed by Snyder to run Flint switched the city’s water source to the Flint River in 2014-15 while a new pipeline was being built from Lake Huron. They argue that Snyder worked in Ingham County, not Genesee County, so the indictment returned in Flint should not stand. But if Genesee is not the right county, prosecutors said, then the case should be transferred to Ingham and not be dismissed.

The Republican National Committee and the state Republican Party want the board to adjourn for 14 days to investigate alleged irregularities in Wayne County, the state's largest and home to Detroit. “Michigan election law clearly requires that the state’s electors must be those nominated by the party that received the most votes — not the Legislature,” says a stock email House Republicans are sending in response to people who contact their offices. Experts on Michigan election law have said the state board's authority is limited in scope and that it must certify the results now that all 83 counties have reported theirs to the state. The deadline is Dec. 13, but that is five days after the federal “safe harbor” date — when Congress cannot challenge any electors named by that date in accordance with state law. In fact, election officials from both political parties have stated publicly that the election went well and international observers confirmed that there were no serious irregularities.

LANSING, Mich. – A state Board of Canvassers' meeting scheduled for Wednesday has been cancelled after canvassers in southeastern Michigan’s Wayne County unanimously certified election results showing Democrat Joe Biden defeated President Donald Trump. The meeting had been scheduled in case the state board needed to canvass any county results if a county failed to certify, according to Tracy Wimmer, spokeswoman for Michigan’s secretary of state. “All counties have certified, so the meeting was unnecessary,” Wimmer wrote in an email. The board is next scheduled to meet Nov. 23 to certify the Nov. 3 general election. Biden crushed Trump in Wayne County, a Democratic stronghold, by more than a 2-1 margin and won Michigan by 146,000 votes, according to unofficial results.

Other Midwest states are facing similar second waves as the weather cools, and she has urged the public to “double down” with precautions to avoid a shelter-in-place order like what was instituted in the spring. Whitmer responded to a tweet sent Sunday night by Scott Atlas, a science adviser to Trump, who urged people to “rise up” after the governor’s announcement. Trump himself has urged supporters to push Whitmer to reopen the state following COVID-19 restrictions. And 14 men have been charged in connection with an alleged plot to kidnap the governor. In Atlanta, outside the state Capitol in the longtime Republican stronghold of Georgia, chants of “Lock him up!” rang out among an estimated 1,000 Trump supporters. Contrary to the claims of Trump supporters, there has been no evidence of any serious vote fraud. At the Arizona Capitol in Phoenix, a crowd swelled to more than 1,000 within hours. More than 1,000 people gathered at the Texas Capitol in Austin, with police keeping Trump and Biden supporters on opposite sides of the street. Even in a place that wasn't close, Trump supporters gathered in droves to express support for him and vent frustration over the outcome of the election.

LANSING, Mich. – A ballot drive has turned in more than 483,000 signatures for an initiative to prohibit discrimination against LGBTQ people in Michigan by amending the state's civil rights law. “Michigan stands united to bring LGBTQ rights into law for the first time," said Trevor Thomas, co-chair of Fair and Equal Michigan. The proposal would revise the state's 1976 law to bar discrimination based on sexual orientation or gender identity in employment, housing and public accommodations. In June, the U.S. Supreme Court ruled that a landmark federal civil rights law protects gay, lesbian and transgender people from discrimination in employment. Backers of the Michigan measure said it would provide broader protections in local employment, housing and public accommodations.

A judge ordered three of six men charged in the case held without bond until trial, delaying rulings on two defendants. It wasn’t immediately clear if talk of targeting Virginia’s Democratic governor, Ralph Northam, continued beyond the meeting. Trask, the FBI agent, testified that authorities learned of the June meeting in Ohio while investigating various anti-government groups. Some defendants conducted surveillance of her northern Michigan house in August and September, according to the complaint. Michigan, and particularly the Detroit area, were hit hard early during the pandemic, leading Whitmer to tightly restrict personal movement and the economy.

Clerks were told to reissue correct ballots and tell voters to ignore the erroneous ballot if they received one.

A proposed $600 million deal between the state of Michigan and residents of the impoverished, majority-Black city of Flint who were harmed by lead-tainted water is a step toward making amends for a disaster that upended life in the city, Gov. More than two years of negotiations between the state and attorneys representing thousands of Flint residents produced an agreement to create a fund from which victims will be able to seek payments. The proposed deal announced Thursday would need to be approved by U.S. District Judge Judith Levy, who is overseeing lawsuits against the state. Residents of the city with a population of nearly 100,000 people used bottled water quickly began complaining that the water was discolored and had a bad taste and smell. They blamed it for rashes, hair loss and other health concerns, but local and state officials insisted it was safe.

The League of Women Voters of Michigan and three voters sued in May, seeking a declaration that absentee ballots be counted as long as they are mailed on or before Election Day and are received within six days of the election. The plaintiffs, who will appeal to the state Supreme Court, pointed to voters' new constitutional rights to cast an absentee ballot without giving a reason 40 days before an election and to do it in person or by mail. It also said the deadline especially burdens undecided and late-deciding voters and said at least 11 states count ballots sent by Election Day. About 1.75% of ballots were not counted in the recent May local elections because they came in too late. A similar suit funded by Priorities USA, a powerful super PAC in Democratic politics is pending in the state Court of Claims.

The plan was to circle the Capitol with as many honking vehicles to protest the stay-at-home order.
