Sylvia Romo doesn't live in district she's running to represent

Romo applying for legal appeal to run

SAN ANTONIO – Former Bexar County Tax Assessor Collector Sylvia Romo is running for the District 26 state Senate seat vacated by Leticia van de Putte. 

There's only one problem -- Romo doesn't live in the district.

She is now considering filing a legal appeal to the rule requiring residency because this is a special election, not a general election.

Rep. Jose Menendez, who is already running in the race, said Romo is a friend and he will wait to comment until the residency issue is settled. 

Converse Mayor Al Suarez and Rep. Trey Martinez are also in the race.

Suarez said candidates should play by the rules, but that he is simply focused on his campaign.

Van de Putte vacated her seat to run for mayor of San Antonio. 

The special election date has been set for Jan. 6.
