The asset protection department for AT&T contacted investigators with the Department of Public Safety last month after one of its stores noticed some of its electronics that it shipped out had disappeared, according to an arrest affidavit.

The affidavit stated that investigators put together a box containing five cellular phones, including two bait phones with tracking devices in them, and had Silva pick them up for delivery.

The affidavit stated Silva drove by his home and met up with another person who he allowed to take some of the phones out of the box.

Later, when Silva brought the box to the FedEx station, agents found only one phone still inside, the affidavit stated.

Investigators said they traced the other phones to a local cell phone store, Simple Mobile.

The affidavit does not mention anyone else facing arrest in the case.
