Suspect taken into custody after assaulting SAPD officers

Daryn Burgess, 40, has been charged with attempted capital murder and other charges in connection with an assault and shooting that involved two San Antonio police officers.

The altercation began as officers responded to a disturbance Sunday at the emergency center at Christus Santa Rosa Hospital on Northwest Military Drive.

San Antonio police investigators said the officers found a man under mental distress and attempted to detain him, but he resisted and fought back.

Officers attempted to subdue the man -- later identified as Burgess -- with a stun gun as he fought back.

"My understanding is that the (stun guns) had no effect on the suspect. In fact, he ripped out the probes twice," said San Antonio police Sgt. Javier Salazar.

Police said Burgess began to physically assault Officer Yvette Meade, and knocked her unconscious.

The other officer at the scene, Officer Robert Aguilar, began to fight with the Burgess and the two got into a struggle over the officer's gun. A shot was fired, wounding Aguilar in the leg.

"They were actively struggling over that weapon when the female officer regained consciousness," Salazar said. "(She) got back into the fight (when she) saw that the suspect was gaining the upper hand."
Police said Meade, an eight-year veteran of the force, fired a shot that hit Burgess in the torso.

Burgess and Aguilar, a five-year veteran, were transported to the hospital.

Burgess was taken into custody Monday morning after he was released from the hospital.

Aguilar underwent surgery for his wound and was expected to make a full recovery.

Police are investigating what sparked the incident and said officers were initially called to the hospital because the suspect refused to leave.

Burgess was charged with aggravated assault on a police officer, taking a weapon from a police officer and attempted capital murder.
