SAN ANTONIO – A repeat drunken driving offender is back behind bars after San Antonio police said she escaped from their custody.
According to an arrest affidavit, Ruth Diaz, 34, was driving a car that became involved in a traffic accident Dec. 10.
While investigating the crash, a police officer said she noticed the smell of alcohol on Diaz's breath.
The officer said she also noticed Diaz had two prior DWI convictions, and arrested her on what was her third DWI charge.
The affidavit stated that because of injuries she suffered in the crash, Diaz had to be taken to a hospital for treatment.
According to the affidavit, while Diaz was there, she asked hospital staffers if she could use the restroom, but walked out of the building instead.
Police tracked down Diaz Thursday and arrested her on a charge of escape.
