Appellate court dismisses VIA lawsuit

Lawsuit claimed transit provider lied to tax payers

The state's Third Court of Appeals on Thursday dismissed a lawsuit filed against VIA Metropolitan Transit. 

The suit was filed by George Alejos. 

At issue was VIA's proposed $32.9 million multi-modal transit center on the city's West Side, which is being funded by sales tax revenue from a voter-approved Advanced Transportation District. 

Alejos claimed VIA violated its contract with voters because the transit provider promised the money would not be used to pay for light rail projects. Opponents of VIA's modern streetcar plan say the multi-modal center will be a centerpiece of the rail system. 

The three-judge panel dismissed the case after Alejos failed to pay the $3.8 million bond to continue his appeal. Alejos' inability to pay the bond resulted in the court finding that he lacked the jurisdiction necessary to appeal.
