Man convicted in shooting of Bexar deputy back in jail

Michael Benitez, 35, arrested months after release from prison

SAN ANTONIO – Michael Benitez, 35, has been in and out of jail since 1997.

He has a laundry list of criminal charges, including possession of marijuana, evading arrest and aggravated assault on a public servant.

He was convicted in 2002 of shooting a Bexar County Sheriff's deputy in 2001.

"This is somebody who has demonstrated that he is not scared of law enforcement, and he's willing to pull out a gun and shoot an officer, if he has to," said BCSO spokesman James Keith.

Benitez, who served 12 years of a 29-year sentence for aggravated assault on a public servant, was released from prison in December.

Benitez was arrested again Wednesday during the execution of a search warrant at a home in the 2400 block of Texas Avenue.

"Coming from this area now, no, it doesn't surprise me. What surprises me is that we didn't hear anything, that there were cops around here arresting somebody," said neighbor Rosie Montoya.

The BCSO Narcotics Unit found more than a pound of methamphetamine and cocaine in the home. Officials said they also found a loaded .40-caliber semi-automatic handgun.

"He has proven to society that he's not capable of functioning without committing crimes," Keith said.

Montoya said her family has lived in the area for 30 years but has recently become scared to go out at night.

"I'll hear cops on the loudspeaker talking about, 'Put the knife down,' and whatnot. But like I said, during the day, for the most it's a quiet neighborhood. But at night, it's not so quiet," Montoya said.

Benitez is being booked into a detention center on federal drug and weapons charges.
