Defenders investigate Fair DUI Flyer from viral YouTube video

SAN ANTONIO – Will a concept that's gotten more than 3 million YouTube views work here in San Antonio?

Defense attorney Warren Redlich created and has tested the Fair DUI Flyer at several checkpoints in Florida. He advises drivers to hold the flyer, created for the state in which they're driving, up to a rolled-up window with a valid driver's license if officers want to conduct a driving while intoxicated investigation.

"You're saying, ‘Hey, look, here's my rights. I want to use them,'" DWI attorney Brent de la Paz said.

While de la Paz said the flyer could work, DWI lawyer Michael Zamora doesn't agree that people should try it.

"Looks like a good recipe to getting your windshield broken and getting dragged out of your car," Zamora said.

A statement from the San Antonio Police Department said the department doesn't utilize checkpoints and people must physically sign any traffic citations or they will be placed under arrest.

Bexar County statistics show there were more than 7,000 DWI arrests last year and SAPD said there have been 60 DWI fatalities in the last year. 

Officers like drug recognition expert Shannon Purkiss are trained to notice any unusual behavior.

"If they're refusing to cooperate, to me, that's a sign of intoxication," Purkiss said. "What are they trying to hide?"

Both de la Paz and Zamora said the best advice if someone is pulled over on suspicion of DWI is to politely refuse to answer any questions, ask for a lawyer and don't take any field sobriety test. But ultimately, the only way to avoid DWI is for a person not to put themselves in the situation or circumstance to begin with.
