Suspect accused of killing man over parking spot on trial

Defense expected to present its case Thursday

SAN ANTONIO – A man police say shot and killed another man over a dispute about a parking spot is now on trial.

The state wrapped up its side of the case Wednesday in the murder trial of 75-year-old Franklin Martinez.

A forensic scientist was called to the stand and identified Martinez’s gun.

Martinez is accused of murder in the death of Manuel Lopez. The shooting happened on Elvira Street on the West Side just a few days after Thanksgiving in 2015.

An arrest affidavit said Martinez told the victim, “You need to tell your buddies not to park in front of the house.” When the victim responded saying, “You don’t own the street” and threw a can at Martinez’s truck, Martinez pulled out a small handgun and shot Lopez in the chest.

Lopez died a few days later.

The defense is expected to present its case Thursday morning.
